Everyone expects to be treated correctly by medical professionals and when something does go wrong, it can be distressing and even life-changing in some cases. Many of the people who come to us after suffering the effects of medical negligence are naturally very upset about what has happened.

Our process

  • After you contact HappyClaim you will speak with a registered nurse who has training and experience in supporting people who have suffered injury and ill health at the hands of the medical profession. They will discuss in confidence with you the circumstances that have lead to you becoming injured or in poor health.
  • This will include the treatment you have received, the nature of your injuries or ill health, who you believe was responsible and why you believe that they were negligent. The information you give us will help to establish the facts of what has happened and enable us to make an initial assessment of the likelihood of you being able to pursue a medical negligence claim.
  • If there is evidence of negligence on behalf of an individual or organisation responsible for your treatment or care, based on the information you provide, a specialist solicitor will be appointed to make initial investigations into the circumstances of your case.
  • This will involve applying for the medical records held by the person or organisation where you have received treatment or care. It will also be important to make a formal complaint against the person or organisation.
  • At this stage our solicitors may also arrange for an independent medical report to be obtained. You would need to meet a doctor so that a report can be prepared regarding the nature of your injuries/ill health, the effect it has had on you and any likely future/ongoing effects.

Once these initial investigations have been completed, our solicitors will have a clearer understanding of the likelihood of you successfully making a medical negligence claim. This information would then form the basis on which to launch your claim against the person or organisation responsible for your injuries or ill health.
