If you have suffered a holiday injury on a trip booked through a UK tour operator, you may be eligible for compensation. The Package Travel, Package Holiday, and Package Tour Regulations 1992 were created to provide protection for people who suffer a holiday injury but find it difficult to pursue a compensation claim in the country in which the accident happened.

The Package Travel, Package Holiday and Package Tour Regulations 1992


These Regulations state that a package deal consists of two out of three of the following activities:

  • transport
  • accommodation
  • an excursion or any other significant activity

The Regulations mean that if you sustain a holiday injury on an activity that was organised by the tour operator as part of your package deal, you can make a holiday accident claim against your tour operator in the UK.

It is much easier to make a holiday injury claim in the UK rather than abroad because you do not have to worry about the language barrier or travelling abroad if you want to meet your representation face to face. An additional benefit of making a holiday accident claim in the UK is that the amount of compensation awarded for your personal injury may also be greater in the UK than in the country where your accident happened.
